Apple, Google and Yahoo under investigation

Posted by 3o5 | Posted in MISC, Politics, Technology | Posted on 04-06-2009

Apple, Google, and Yahoo are being investigated got anti-trust violations. The US Department of Justice is looking into the companies hiring and retention practices. Of particular interest is the use of employee contracts to prevent employees from leaving “the mother ship” and seeking greener pastures.

Non-Compete and Non-Disclosure agreements are nothing new when it comes to upper level or technical employees. I have had to sign them at every company I have worked for. Primarily they are used to prevent a disgruntled employee with sensitive information from to another company and spilling the beans. However when these are used to prevent good employees from obtaining better work (or pay) is when the system breaks down.

The DoJ thinks that Apple, Google and Yahoo might be engaging in this type of preventative behavior not to protect company secrets but to prevent the competition from gaining a talented employee. They feel that this behavior stifles competition and harms consumers.

The review is said to be “industry-wide” and in preliminary stages, according to the report, which cited two unnamed sources. Companies that agree not to hire away talent could be stifling competition, the report noted.

Representatives for Apple, Google, and Yahoo, as well as the Department of Justice did not immediately respond to requests for comment.

Tech companies, known for their exhaustive recruiting efforts, have waged fierce battles to maintain top talent. In one closely watched case, Google was sued by Microsoft in 2005 over Google’s decision to hire Kai-Fu Lee away from Microsoft to run Google’s research operation in China. The two parties eventually settled out of court.

Adobe Unveils BrowserLab in Free Preview

Posted by 3o5 | Posted in Art, MISC, Technology | Posted on 03-06-2009

Adobe Systems today unveiled a free preview of Adobe BrowserLab, a new hosted service that enables Web designers to quickly view and test their sites on a wide variety of browsers and operating systems. Previously code-named Meer Meer, Adobe BrowserLab provides Web professionals with real-time accurate screenshots of browser renderings and includes multiple viewing and diagnostic tools to help designers pinpoint compatibility issues that can compromise the design and layout integrity of a Web site or page.

“Cross-browser testing has been one of the biggest challenges for Web designers because it is such an arduous and time-intensive task,” said Lea Hickman, director, Creative Solutions Business Unit at Adobe. “Now with Adobe BrowserLab, designers have a simple solution that enables comprehensive browser compatibility testing in just a matter of minutes, leaving Web designers with more time to be creative and deliver the high-impact sites customers are demanding.”

“We hear from many design shops who simply don’t have the resources to be able to support all the browsers and it’s very difficult for them to be able to standardize designs which can be damaging to a brand,” said Melissa Webster, vice president and program lead for IDC’s Content and Digital Media Technologies Research Team. “Adobe BrowserLab is a simple solution that can empower the designer and be a big cost savings to the client.”

Key Features of Adobe BrowserLab include support for all modern browsers and operating systems so that Web designers can see how their Web pages will appear across multiple browsers and on a variety of platforms. The initial set of browsers that are supported include Windows® Internet Explorer® 6.x and 7.x; Firefox® 2.x and 3.x; and Safari® 3.x. This capability is enabled by virtualization technology, hosted through a cloud-based application, which eliminates the need to have browsers installed on a system before testing a site. Adobe BrowserLab lets designers compare and contrast browsers via an interface that works on any Adobe Flash Player 10® enabled operating system, making it compatible with Mac and Windows.

In addition, Adobe BrowserLab includes multiple viewing and diagnostic tools to help Web designers easily spot potential issues. For example, designers can view two screenshots from different browsers side-by-side, or they can use the “onion skin mode” to overlay screenshots on top of one another with variable opacity. There is also a zoom function to help zero-in on bugs. Testing preferences can be customized and saved with Browser Sets, for designers who work with specific platforms.

While Adobe BrowserLab can be used by any Web designer it provides Adobe® Dreamweaver® CS4 users extended capabilities to also test Flash technology-based and interactive site elements, including dynamic widgets, rollover effects and AJAX driven content. The direct integration with Dreamweaver CS4 streamlines workflows and allows designers to preview both local and remote Web content without the worry of firewalls or publicly posting confidential client projects.

Pricing and Availability
Adobe BrowserLab is available now in English only as a free preview on a first-come, first-serve basis. It is a tiered release. International versions and the list of supported browsers and operating systems that can be previewed with BrowserLab is expected to grow over time based on customer feedback and demand.

Blizzard’s popular science fiction RTS game StarCraft, which was released in 1998 and since then was able to sell more than 11 million copies worldwide, is “currently scheduled for a release at the end of this year, Blizzard president Mike Morhaime announced today in an Activision Blizzard pre-E3 conference call.

“We’re targeting an end of year release–this year–for StarCraft 2,” said Morhaime of the PC strategy title. “But as always, we won’t release it until it meets our standards and the expectations of our players.”

This confirms earlier rumors that the first installment of the new StarCraft trilogy, Terrans: Wings of Liberty, will be out in time for this year’s holiday season.

Is HTML5 Going To Change The OS Market?

1

Posted by 3o5 | Posted in MISC, Technology | Posted on 31-05-2009

Regardless of the underlying operating system, HTML5 promises the ability to run applications platform-independant. Already being confirmed to be supported by Microsoft, Google, and Mozilla it is more than likely that all major browsers are going to feature an updated interpreter for the new version of the web programming language.

HTML 5 is currently in the developing stage and more than likely to remain in it for a few more years. Despite that, “its focus on running applications within the browser is an important driver of interest in cloud computing, where applications live somewhere off on the Internet and are delivered by the browser.

The focus of future browsers will shift from “going places” to “doing things.” This will be a boon to free operating systems, which will increasingly be able to hide themselves under the browser user interface. While Windows and Mac OSX won’t go away overnight, the pressure on them will be to innovate beyond the browser, perhaps through a common set of extensions for HTML5 applications to use.”

Wiki Operator Sues Apple Over Legal Threats

0

Posted by 3o5 | Posted in MISC, Politics, Technology | Posted on 28-04-2009

bluwiki

The Electronic Frontier Foundation (EFF) filed suit against Apple Inc. today to defend the First Amendment rights of an operator of a noncommercial, public Internet “wiki” site known as BluWiki.

EFF and the San Francisco law firm of Keker & Van Nest represent OdioWorks LLC, which runs the BluWiki website. Like many “wiki” platforms, such as Wikipedia, it is open to the public for collaborative authoring and editing on any topic. The site is entirely noncommercial, operated by OdioWorks as a public service.

Late last year, after BluWiki users began a discussion about making some Apple iPods and iPhones interoperate with software other than Apple’s own iTunes, Apple lawyers demanded removal of the content. In a letter to OdioWorks, the attorneys alleged that the discussions constituted copyright infringement and a violation of the Digital Millennium Copyright Act’s (DMCA’s) prohibition on circumventing copy protection measures. Fearing legal action by Apple, OdioWorks took down the discussions from the BluWiki site.

OdioWorks filed the lawsuit today in order to vindicate its right to restore those discussions. Filed in federal court in San Francisco, the suit seeks a declaratory judgment that the discussions do not violate any of the DMCA’s anti-circumvention provisions, and do not infringe any copyrights owned by Apple.

“I take the free speech rights of BluWiki users seriously,” said Sam Odio, owner of OdioWorks. “Companies like Apple should not be able to censor online discussions by making baseless legal threats against services like BluWiki that host the discussions.”

The discussions on the BluWiki site focused on how hobbyists might enable iPods and iPhones to work with desktop media management software other than Apple’s own iTunes software. The discussions were apparently spurred by Apple’s efforts prevent the iPod Touch and iPhone from working with competing media management software such as WinAmp and Songbird.

“Apple’s legal threats against BluWiki are about censorship, not about protecting their legitimate copyright interests,” said Senior Staff Attorney Fred von Lohmann. “Wikis and other community sites are home to many vibrant discussions among hobbyists and tinkerers. It’s legal to engage in reverse engineering in order to create a competing product, it’s legal to talk about reverse engineering, and it’s legal for a public wiki to host those discussions.”
